These Terms and Conditions ("Terms") govern your access to and use of the ShyamKrishi Technologies Pvt Ltd ("ShyamKrishi", "we", "our", or "us") website, web dashboard, mobile application, IoT devices and related services (collectively, the "Platform").

By registering an account, accessing the Platform, or using any ShyamKrishi device or service, you confirm that you have read, understood and agree to be bound by these Terms and our Privacy Policy.

If you are using the Platform on behalf of an organisation, you represent that you have the authority to bind that organisation to these Terms.

We reserve the right to update these Terms at any time. We will notify you of material changes via email or a notice within the Platform. Continued use after such notification constitutes acceptance of the revised Terms.

ShyamKrishi provides an integrated smart farming platform comprising:

IoT Devices: Field-deployable sensors that monitor soil, weather and environmental conditions.

Cloud Platform: A web-based dashboard and data management system that collects, stores and presents sensor data.

AI Insights Engine: An analytical layer that processes farm data and generates recommendations.

Mobile Application: An Android application providing mobile access to the dashboard and notifications.

The Platform is intended for agricultural and farm management purposes. It is not intended to replace professional agronomic, legal, financial or safety advice.

To access most features of the Platform, you must register for an account. You agree to provide accurate, current and complete information during registration and to keep your account information up to date.

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must notify us immediately at info@shyamkrishi.in if you suspect any unauthorised use of your account.

We reserve the right to suspend or terminate accounts that we reasonably believe are being used in violation of these Terms, or that have been inactive for an extended period, with reasonable prior notice where practical.

You may not create multiple accounts for the same individual or share your account credentials with third parties outside of your organisation.

ShyamKrishi IoT devices remain the property of ShyamKrishi Technologies Pvt Ltd unless explicitly transferred under a separate written purchase agreement.

You are responsible for the proper installation, care and security of devices deployed on your property. You must not tamper with, reverse engineer or modify devices in ways not authorised by ShyamKrishi.

ShyamKrishi may push firmware updates to devices over-the-air to improve performance, security or functionality. Such updates are part of the service and cannot be declined without affecting platform compatibility.

Device performance may vary based on environmental conditions, connectivity availability and power supply. ShyamKrishi does not guarantee uninterrupted data collection in all field conditions.

You retain ownership of the farm and sensor data generated by your IoT devices ("Your Data"). By using the Platform, you grant ShyamKrishi a limited, non-exclusive licence to process, store and use Your Data for the purpose of operating and improving the Platform and providing services to you.

ShyamKrishi may use aggregated and fully anonymised data derived from Your Data to improve AI models, conduct research and develop new features. Individual farm data will not be disclosed to third parties in identifiable form without your consent, except as described in our Privacy Policy.

You are responsible for ensuring that any data you input into or generate through the Platform does not violate the rights of any third party.

You agree to use the Platform only for lawful purposes and in a manner consistent with these Terms. You must not:

Use the Platform in any way that violates applicable local, national or international law or regulation.

Attempt to gain unauthorised access to the Platform, its servers, or any connected systems or networks.

Reverse engineer, decompile, disassemble or otherwise attempt to extract the source code of any software component of the Platform.

Use the Platform to transmit, distribute or store material that is unlawful, harmful, threatening, abusive, defamatory or otherwise objectionable.

Overload, disrupt or interfere with the normal operation of the Platform infrastructure.

Use automated tools, bots or scripts to scrape or extract data from the Platform without prior written consent.

Access to certain features of the Platform may require a paid subscription. Subscription plans, pricing and terms will be communicated separately and may change with reasonable notice.

All fees are quoted in Indian Rupees (INR) unless otherwise stated and are exclusive of applicable taxes.

Payment obligations are non-cancellable and fees paid are non-refundable except where required by applicable law or explicitly stated in a separate agreement.

Failure to pay applicable fees may result in suspension of access to the Platform after reasonable notice.

Hardware devices are priced and invoiced separately from software subscription plans. Please contact us for current pricing.

The Platform and AI recommendations are provided as informational tools to assist farming decisions. They do not constitute professional agronomic, scientific, legal or financial advice. You are solely responsible for all farming, irrigation and crop management decisions you make.

ShyamKrishi does not guarantee that sensor readings, AI recommendations or platform data are accurate, complete or suitable for any particular purpose. Agricultural outcomes depend on many factors outside our control.

To the maximum extent permitted by applicable law, ShyamKrishi shall not be liable for any indirect, incidental, special, consequential or punitive damages arising from your use of or reliance on the Platform, including but not limited to crop loss, yield reduction, equipment damage or loss of business.

ShyamKrishi's total liability for any claim arising out of these Terms or the use of the Platform shall not exceed the total fees paid by you to ShyamKrishi in the twelve months preceding the claim.

Nothing in these Terms limits liability for fraud, death or personal injury caused by negligence, or any other liability that cannot be excluded or limited under applicable law.

The Platform, including its software, design, text, graphics, AI models, algorithms and documentation, is the intellectual property of ShyamKrishi Technologies Pvt Ltd and is protected by applicable copyright, trademark and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable licence to access and use the Platform solely for your own agricultural management purposes during the term of your subscription.

You must not reproduce, distribute, modify, create derivative works of, publicly display or commercially exploit any part of the Platform without our prior written consent.

The ShyamKrishi name, logo and associated marks are trademarks of ShyamKrishi Technologies Pvt Ltd. You must not use these marks without our written permission.

You may terminate your account at any time by contacting us at info@shyamkrishi.in. Termination does not entitle you to a refund of any prepaid fees unless otherwise agreed in writing.

We may suspend or terminate your access to the Platform immediately if you materially breach these Terms, if you fail to pay applicable fees after notice, or if required by law.

Upon termination, your right to use the Platform ceases. Sections of these Terms that by their nature should survive termination — including data ownership, intellectual property, disclaimers and limitation of liability — will continue to apply.

These Terms are governed by and construed in accordance with the laws of India. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the competent courts of India.

Before initiating formal legal proceedings, we encourage you to contact us at info@shyamkrishi.in to attempt to resolve any dispute informally and in good faith.

Entire Agreement: These Terms, together with the Privacy Policy and any applicable subscription agreement, constitute the entire agreement between you and ShyamKrishi with respect to the Platform.

Severability: If any provision of these Terms is found to be unlawful or unenforceable, that provision will be limited or removed to the minimum extent necessary, and the remaining provisions will remain in full force.

No Waiver: Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

Assignment: You may not assign your rights or obligations under these Terms without our prior written consent. We may assign our rights to a successor entity.
